(L&D) - The Ministry of Construction has proposed amendments and supplements to a number of points and clauses under Article 38, which stipulates the order and procedures for putting passenger bus stations into operation, of Ministerial Circular No. 36/2024 of the Ministry of Transport.

Accordingly, the Ministry of Construction is drafting a Circular amending and supplementing a number of Articles of Ministerial Circular No. 36/2024 of the Minister of Transport dated November 15, 2024, which provides regulations on the organization and management of automobile transport activities and the operation of bus stations, parking lots, rest stations, and roadside stops; stipulates the order and procedures for putting bus stations and rest stations into operation; Ministerial Circular No. 40/2024 of the Minister of Transport dated November 15, 2024, which provides regulations on disaster prevention, response, and recovery in the road transport sector; Ministerial Circular No. 41/2024 of the Minister of Transport dated November 15, 2024, which provides regulations on the management, operation, exploitation, and maintenance of road infrastructure; and Ministerial Circular No. 22/2014 of the Minister of Transport dated June 6, 2014, which provides guidance on the operation and exploitation procedures for ferry terminals and river-crossing passenger terminals using single-ended ferries for carrying passengers and automobiles.

The Ministry of Construction proposes amendments and supplements to a number of points and clauses under Article 38, which stipulates the procedures for putting passenger bus stations into operation under Ministerial Circular No. 36/2024 of the Ministry of Transport.

According to Clause 3, Article 38 of Ministerial Circular No. 36/2024 of the Ministry of Transport, the process for handling applications for announcing the operation of a passenger bus station is as follows:

Within 10 days from the date of receipt of a complete and valid application, the Department of Transport shall inspect the classification criteria of the station in accordance with the National Technical Regulation on Passenger Bus Stations and prepare an inspection report.

If, after inspection, the station fails to meet the criteria, the deficiencies must be clearly stated in the inspection report, and within 2 working days from the date of completion of the inspection, the Department of Transport must notify the passenger bus station operator. If the station meets the technical standards of the category applied for, the Department of Transport shall, within 5 working days from the date of completion of the inspection, issue a decision announcing that the passenger bus station is officially put into operation, using the prescribed form. The decision takes effect from the date of signing and remains valid indefinitely.

To simplify administrative procedures in accordance with Decision No. 1406/QD-BXD, and to transfer the responsibility from the Department of Transport to the Department of Construction in line with the two-tier local government model and the streamlined state administrative structure, the Ministry of Construction proposes to amend the application handling process as follows:

Within 5 days from the date of receipt of a complete and valid application, the Department of Construction shall inspect the classification criteria of the station in accordance with the National Technical Regulation on Passenger Bus Stations and prepare an inspection report.

If, after inspection, the station fails to meet the criteria, the deficiencies must be clearly stated in the inspection report, and within 2 working days from the date of completion of the inspection, the Department of Construction must notify the passenger bus station operator. If the station meets the technical standards of the category applied for, the Department of Construction shall, within 3 working days from the date of completion of the inspection, issue a decision announcing that the passenger bus station is officially put into operation, using the prescribed form. The draft clearly states that the results of administrative procedure processing will be provided in electronic form, except in cases where individuals or organizations request a paper copy.

Similarly, the Ministry of Construction proposes to amend Clause 6, Article 38 of Ministerial Circular No. 36/2024 of the Ministry of Transport regarding the process for handling applications for re-announcement as follows:

Within 3 working days from the date of receipt of a complete and valid application, the Department of Construction shall inspect the classification criteria of the station and prepare an inspection report.

If, after inspection, the station fails to meet the criteria, the deficiencies must be clearly stated in the inspection report, and within 2 working days from the date of completion of the inspection, the Department of Construction must notify the passenger bus station operator. If the station meets the technical standards of the category applied for, within 3 working days from the date of completion of the inspection, the Department of Construction shall issue a decision announcing that the passenger bus station is officially put into operation, using the prescribed form. The results of administrative procedure processing will be provided in electronic form, except in cases where individuals or organizations request a paper copy.
