Abolition of Certain Legal Documents Issued by the Prime Minister

(L&D) – On December 1, 2025, Deputy Prime Minister Ho Quoc Dung signed Prime Minister’s Decision No. 44/2025/QD-TTg, abolishing certain legal documents issued by the Prime Minister.

Abolition of 39 normative legal documents of the Prime Minister.

Accordingly, the Decision has abolished a total of 39 legal documents issued by the Prime Minister, including:

1. Decision No. 104/2000/QD-TTg dated August 25, 2000, of the Prime Minister on approving the National Strategy for Clean Water Supply and Rural Sanitation up to 2020.

2. Decision No. 63/2002/QD-TTg dated May 20, 2002, of the Prime Minister on flood and storm prevention and mitigation of natural disasters.

3. Decision No. 132/2002/QD-TTg dated October 8, 2002, of the Prime Minister on resolving production and residential land for ethnic minorities residing in the Central Highlands.

4. Decision No. 64/2003/QD-TTg dated April 22, 2003, of the Prime Minister on approving the "Plan for thoroughly handling establishments causing serious environmental pollution."

5. Decision No. 256/2003/QD-TTg dated December 2, 2003, of the Prime Minister on approving the National Strategy on Environment Protection up to 2010 with orientation to 2020.

6. Decision No. 179/2004/QD-TTg dated October 6, 2004, of the Prime Minister on approving the strategy on application and development of natural resource and environment information technology up to 2015 with orientation to 2020.

7. Decision No. 81/2006/QD-TTg dated April 14, 2006 of the Prime Minister on approving the National Strategy on Water Resources to 2020.

8. Decision No. 171/2007/QD-TTg dated November 14, 2007 of the Prime Minister on the establishment of the Cau River Basin Environmental Protection Committee.

9. Decision No. 33/2008/QD-TTg dated February 27, 2008 of the Prime Minister on approving the Development Strategy of Vietnam's Surveying and Mapping Industry to 2020.

10. Decision No. 157/2008/QD-TTg dated December 1, 2008, of the Prime Minister on the establishment of the Environmental Protection Committee for the Dong Nai River System Basin.

11. Decision No. 04/2018/QD-TTg dated January 23, 2018 of the Prime Minister promulgating the Regulation on methods for determining mineral potential assessment costs, mineral exploration costs that must be reimbursed, and reimbursement methods; regulations on the collection, management, and use of mineral potential assessment costs and mineral exploration costs invested by the State.

12. Decision No. 10/2023/QD-TTg dated April 24, 2023 of the Prime Minister stipulating the functions, tasks, powers and organizational structure of the General Department of Hydrometeorology under the Ministry of Natural Resources and Environment.

13. Decision No. 84/2010/QD-TTg dated December 15, 2010 of the Prime Minister on promulgating the Regulation on oil and gas exploitation.

14. Decision No. 49/2017/QD-TTg dated December 21, 2017 of the Prime Minister on clearing works, equipment and means serving oil and gas activities.

15. Decision No. 34/2018/QD-TTg dated August 10, 2018, of the Prime Minister defining the functions, tasks, powers, and organizational structure of the General Department of M under the Ministry of Industry and Trade.

16. Decision No. 05/2024/QD-TTg dated March 26, 2024 of the Prime Minister regulating the mechanism for adjusting average retail electricity prices.

17. Decision No. 138/2000/QD-TTg dated November 29, 2000 of the Prime Minister on merging the project of settlement, the project of supporting ethnic minorities in special difficulties, the Program of building commune cluster centers in mountainous and highland areas into the Program of socio-economic development of communes in special difficulties in mountainous and remote areas.

Decision No. 69/2008/QD-TTg dated May 28, 2008 of the Prime Minister on approving the addition of the list of particularly disadvantaged communes, border communes, and safe zone communes to the investment scope of Program 135 Phase II and the list of communes excluded from the investment scope of Program 135 Phase II.

19. Decision No. 03/2019/QD-TTg dated January 15, 2019, of the Prime Minister promulgating the criteria for identifying communes and villages that have achieved the objectives of Project 2 (Program 135) under the National Target Program on Sustainable Poverty Reduction for the 2016–2020 period.

Decision No. 31/2020/QD-TTg dated September 29, 2020, of the Prime Minister amending Article 5 of Decision No. 03/2019/QĐ-TTg dated January 15, 2019, on promulgating the criteria for identifying communes and villages that have achieved the objectives of Project 2 (Program 135) under the National Target Program on Sustainable Poverty Reduction for the 2016–2020 period.

36. Decision No. 61/2014/QD-TTg dated October 30, 2014 of the Prime Minister stipulating the functions, tasks, powers and organizational structure of the General Department of Civil Judgment Enforcement under the Ministry of Justice.

37. Decision No. 19/2023/QD-TTg dated August 2, 2023, of the Prime Minister amending and supplementing certain articles of Decision No. 61/2014/QD-TTg dated October 30, 2014, on the functions, tasks, powers, and organizational structure of the General Department of Civil Judgment Enforcement under the Ministry of Justice.

38. Decision No. 111/2007/QD-TTg dated 20 July 2007 of the Prime Minister promulgating the Regulation on coordination between the Ministry of National Defence and the Ministry of Industry, ministries, sectors, and provincial People’s Committees in state management of defense industry.

39. Directive No. 33/2006/CT-TTg dated September 8, 2006 of the Prime Minister on combating negativity and overcoming the disease of achievement in education.

According to Deputy Minister of Justice Phan Chi Hieu, in recent years, several ministries, ministerial-level agencies, and local authorities have conducted reviews and identified a number of legal normative documents issued by the Prime Minister that are no longer applied in practice but lack legal grounds to be deemed expired under the Law on Promulgation of Legal Normative Documents. In principle, these documents must still be regarded as “in effect.”

To ensure the openness and transparency of the legal system, and to comply with the rules on the validity of legal documents as prescribed in the Law on Promulgation of Legal Normative Documents No. 64/2025/QH15 (as amended and supplemented by Law No. 87/2025/QH15) and Decree No. 78/2025/ND-CP dated 1 April 2025 detailing several articles and implementation measures of the Law on Promulgation of Legal Normative Documents (as amended and supplemented by Decree No. 187/2025/ND-CP), the issuance of a document to repeal the aforementioned instruments is necessary.

The repeal of legal normative documents that are no longer appropriate is an important task to ensure the transparency and consistency of the legal system, while also facilitating State administration and the activities of citizens and businesses.

Decision No. 44/2025/QD-TTg enters into force on 20 January 2026.
