Implementation of the Amended Advertising Law: Technical Standards to Be Issued Before November 15

(L&D) – The Law Amending and Supplementing a Number of Articles of the Law on Advertising No. 75/2025/QH15 was adopted by the 15th National Assembly at its 9th session on June 16, 2025, and will take effect on January 1, 2026.

On August 26, 2025, Deputy Prime Minister Mai Van Chinh signed Decision No. 1838/QĐ-TTg of the Prime Minister, issuing the Plan for the Implementation of the Law Amending and Supplementing a Number of Articles of the Law on Advertising. The Ministry of Construction will take the lead, in coordination with relevant agencies, to issue a circular on technical standards for outdoor advertising media, to be completed before November 15, 2025.

Under the plan, ministries, ministerial-level agencies, government bodies, provincial and centrally-run municipal People’s Committees, and relevant organizations must review, amend, or propose amendments to legal normative documents to ensure consistency with the Law. This is aimed at creating a unified, effective, and enforceable legal basis for the management and operation of advertising nationwide.

The Ministry of Culture, Sports and Tourism has been assigned to draft a decree detailing and guiding the implementation of the Law on Advertising and to submit it to the Government before October 15, 2025.

The Ministry of Construction will take the lead, in coordination with the Ministry of Culture, Sports and Tourism and other relevant agencies, to issue a circular on technical standards for outdoor advertising media, to be completed before November 15, 2025.

In December 2025, the Ministry of Culture, Sports and Tourism will hold a conference to disseminate and introduce the contents of the Law along with detailed guiding documents. Press agencies and online portals of state bodies will also update the full text of the Law and related guidance materials to facilitate easy access for officials, public employees, workers, and citizens.

In addition, the Ministry of Culture, Sports and Tourism, in coordination with the Ministry of Justice and relevant agencies, is implementing various forms of legal dissemination, education, and communication. These include compiling materials, publishing them on the National Portal for Legal Dissemination and Education at http://pbgdpl.gov.vn, as well as producing dedicated sections, programs, and reports in the media.

The plan also requires clear identification of responsibilities and coordination mechanisms between central and local agencies. Implementation must be timely, ensuring greater awareness and accountability among all levels of government, sectors, and the public in correctly applying the new regulations. With a specific roadmap and clearly defined responsibilities, the plan is expected to ensure that the amended Advertising Law is effectively put into practice, meeting the requirements of modern, transparent, and efficient management in the advertising sector.

The Ministry of Culture, Sports and Tourism, the Ministry of Health, the Ministry of Industry and Trade, the Ministry of Agriculture and Environment, the Ministry of Construction, the Ministry of Public Security, the Ministry of Finance, provincial and centrally-run municipal People’s Committees, together with relevant agencies, organizations, and units, shall take the lead in reviewing and carrying out state management tasks assigned under the Law Amending and Supplementing a Number of Articles of the Law on Advertising, in accordance with their designated sectors, localities, responsibilities, and powers.
