New Legal Policies Effective from May 2025

(L&D) – Regulations on foreign investors’ acquisition of shares in Vietnamese credit institutions; the regime of remuneration for judicial expertise; recruitment regulations for civil servants and public employees… are among the new legal policies effective from May 2025.

Principles for determining fines in administrative violations

The Government issued Decree No. 68/2025/ND-CP dated March 18, 2025, amending Decree No. 118/2021/ND-CP guiding the Law on Handling of Administrative Violations.

Accordingly, the principles for determining specific fines for an administrative violation in cases with aggravating or mitigating circumstances are as follows:

- The specific fine for an administrative violation shall be the average level of the fine bracket prescribed for such violation;

- If there is one mitigating circumstance, the specific fine shall be determined within the range from above the minimum level to below the average level of the fine bracket; in case of two or more mitigating circumstances, the minimum level of the fine bracket shall apply;

- If there is one aggravating circumstance, the specific fine shall be determined within the range from above the average level to below the maximum level of the fine bracket; in case of two or more aggravating circumstances, the maximum level of the fine bracket shall apply;

- If both aggravating and mitigating circumstances exist, one aggravating circumstance shall be offset by one mitigating circumstance;

- If decrees on sanctioning administrative violations in specific sectors of state management stipulate principles for determining specific fines in cases with aggravating or mitigating circumstances, such provisions shall apply.

This Decree takes effect from May 2, 2025.

New regulations on foreign investors acquiring shares in Vietnamese credit institutions

On March 18, 2025, the Government issued Decree No. 69/2025/ND-CP, amending and supplementing certain provisions of Decree No. 01/2014/ND-CP on foreign investors’ acquisition of shares in Vietnamese credit institutions (CIs).

Regarding shareholding ratios of foreign investors, Clause 5, Article 7 of Decree No. 01/2014/ND-CP is amended and supplemented as follows: “5. The total shareholding of foreign investors shall not exceed 30% of the charter capital of a Vietnamese commercial bank, except as provided in Clauses 6, 6a of this Article or during the period of implementation of the provisions in Clause 9, Article 14 of this Decree. The total shareholding of foreign investors shall not exceed 50% of the charter capital of a Vietnamese non-bank credit institution, except as provided in Clause 6 of this Article.”

At the same time, Clause 6, Article 7 of Decree No. 01/2014/ND-CP is also amended and supplemented: “6. In special cases to ensure the safety of the credit institution system, the Prime Minister shall decide on the shareholding ratio of a foreign organization, a foreign strategic investor, and the total shareholding ratio of foreign investors in a weak or troubled credit institution exceeding the limits prescribed in Clauses 2, 3, and 5 of this Article, on a case-by-case basis.”

Decree No. 69/2025/ND-CP also supplements Clause 6a after Clause 6, Article 7 of Decree No. 01/2014/ND-CP: “6a. The total shareholding of foreign investors in a commercial bank subject to mandatory transfer (excluding commercial banks in which the State holds more than 50% of charter capital) may exceed 30% but shall not exceed 49% of the charter capital of the commercial bank subject to mandatory transfer, in accordance with the mandatory transfer plan approved, and implemented within the period of such plan.”

Decree No. 69/2025/ND-CP takes effect from May 19, 2025.

Regime of remuneration for judicial expertise

Deputy Prime Minister Le Thanh Long signed Decision No. 08/2025/QD-TTg dated April 4, 2025 on the regime of remuneration for judicial expertise.

Accordingly, the regime of remuneration for judicial expertise per case applies to expertise in forensic medicine and forensic psychiatry. Compared with Decision No. 01/2014/QD-TTg currently in force, the remuneration rates have been increased.

Under the new provisions, a person conducting expertise on a living person at the request of the authority shall receive VND 400,000 per required expertise item, or VND 500,000 per required expertise item in cases of in-depth professional consultation conducted by experts in specialized medical fields.

Decision No. 08/2025/QD-TTg takes effect from May 20, 2025.

New regulations on recruitment of civil servants and public employees

On March 17, 2025, the Ministry of Home Affairs issued Circular No. 001/2025/TT-BNV on Internal Rules and Regulations for Recruitment, Promotion, and Rank Advancement of Civil Servants and Public Employees.

Accordingly, candidates participating in recruitment for civil servants and public employees shall:

(1) Be present in the examination room on time. Candidates arriving late after the official start of the examination may still be admitted in the following cases:

a- No more than 05 minutes late for tests with a maximum duration of 30 minutes, or no more than 10 minutes late for tests with a maximum duration of 60 minutes or more;

b- In case of force majeure events or objective obstacles under law preventing timely arrival, the Head of the Examination Board, Interview Board, or Assessment Board shall report to the Chairperson of the Council for consideration and decision on whether the candidate may be admitted.

(2) Dress neatly, properly, and respectfully.

(3) Present the Citizen Identity Card or one of the lawful identity documents with photo and personal information.

(4) Sit in the correct position according to candidate number or as designated by the Examination Council.

(5) Bring into the examination room only: ruler, pens; drinking water in a transparent container without labels or any markings; documents required for each test; certain medicines necessary under medical records.

Mobile phones, recorders, cameras, computers, devices for data storage, transmission, or reception, and other technical means for recording or transmitting information are strictly prohibited, unless otherwise provided.

New policy for children, pupils, and students in ethnic minority and mountainous areas

The Government issued Decree No. 66/2025/ND-CP dated March 12, 2025, providing policies for nursery children, pupils, and students in ethnic minority and mountainous areas, specially disadvantaged communes in coastal and island regions, and educational institutions with such beneficiaries. The Decree specifies applicable subjects, conditions, principles, benefit levels, procedures for approval, provision of rice and funding for policy implementation for nursery children, pupils in general education institutions, pupils in preparatory universities, and students in continuing education institutions in ethnic minority and mountainous areas, and specially disadvantaged communes in coastal and island regions.

Decree No. 66/2025/ND-CP takes effect from May 1, 2025.

New regulations on direct admission

On March 19, 2025, the Ministry of Education and Training issued Circular No. 06/2025/TT-BGDDT, amending and supplementing several articles of the Regulation on University Admission and Admission to Colleges of Early Childhood Education issued together with Circular No. 08/2022/TT-BGDDT.

Accordingly, Clause 8, Article 1 of Circular No. 06/2025/TT-BGDDT amends and supplements Article 17 of the Regulation issued with Circular No. 08/2022/TT-BGDDT regarding registration and direct admission as follows:

- Based on the published admission scheme, training institutions shall organize for candidates eligible for direct admission under Article 8 of the Regulation issued with Circular No. 08/2022/TT-BGDDT to register either online or directly at the institution;

- Training institutions shall conduct direct admission for eligible candidates, publish, and upload the list of conditionally admitted candidates (pending high school graduation) onto the system for processing together with other admission methods according to the general plan, to be completed before candidates register on the system;

- Candidates admitted through direct admission shall register on the system under the Ministry’s general plan to select the program, major, or group of majors to which they have been admitted, or register for other admission options;

- Directly admitted candidates shall confirm enrollment in accordance with the general plan; institutions are not permitted to require early confirmation of enrollment.

Circular No. 06/2025/TT-BGDDT takes effect from May 5, 2025.

Increase in per diem allowance for official duty travel

According to Circular No. 12/2025/TT-BTC dated March 19, 2025 of the Ministry of Finance, effective from May 4, 2025, the per diem allowance for officials, civil servants, and public employees on domestic official duty travel is officially increased to VND 300,000 per day, higher by VND 100,000 compared with the current rate.

The per diem allowance is an additional support beyond salary, calculated from the start to the end of the official duty trip, including travel time and overnight stay. For same-day trips, the head of the agency/unit shall decide the appropriate allowance based on actual hours and distance, in compliance with internal spending regulations.

In particular, officials, civil servants, public employees, and employees performing tasks at sea and on islands shall be entitled to VND 400,000 per actual day, an increase of VND 150,000. Sectors with specific regimes for sea and island duties shall apply the highest rate prescribed.

New regulations on fees for maintaining the national domain name .vn

The Ministry of Finance issued Circular No. 10/2025/TT-BTC dated March 19, 2025, prescribing the rates, collection, remittance, management, and use of fees for maintaining Internet resources and fees for allocation and registration of Internet resources, including the registration fee for the national domain name .vn.

Accordingly, the maintenance fee for using the national domain name “.vn” as from May 3, 2025 shall be implemented in accordance with Section I of the Schedule of Fees and Charges promulgated together with Circular No. 10/2025/TT-BTC, specifically as follows:

- Second-level domain with 1 character: VND 40.000.000/year.

- Second-level domain with 2 characters: VND 10.000.000/year.

- Other second-level domains: VND 350.000/year.

- Third-level domains under shared second-level domains:

+ com.vn, net.vn, biz.vn, ai.vn: VND 250.000/year.

+ The following domain names: edu.vn, gov.vn, org.vn, ac.vn, health.vn, int.vn, and domain names by administrative divisions: VND 100.000/year.

+ info.vn, pro.vn, id.vn: VND 50.000/year.

+ name.vn, io.vn: VND 20.000/year.

- Vietnamese-language domains: VND 20.000/year.

Circular No. 10/2025/TT-BTC takes effect from May 3, 2025.
