The Government approves the draft Law on Public Employees (amended)

(L&D) – The Government unanimously approved the draft Law on Public Employees (amended) submitted by the Ministry of Home Affairs, and assigned the Minister of Home Affairs to incorporate the opinions of Government members, finalize the dossier, and coordinate with agencies of the National Assembly to submit the draft Law.

The Government promulgated Resolution No. 279/NQ-CP dated September 15, 2025, unanimously approving the draft Law on Public Employees (amended) submitted by the Ministry of Home Affairs.

According to the Resolution, the Government assigned the Minister of Home Affairs to incorporate the opinions of Government members, finalize the dossier of the draft Law on Public Employees (amended); and, under the authorization of the Prime Minister, on behalf of the Government, to sign the Government’s submission on the draft Law and related documents to the National Assembly in accordance with regulations.

The Minister of Home Affairs is assigned to coordinate closely with agencies of the National Assembly; to proactively report and provide explanations during the process of appraisal and incorporation of opinions from the Standing Committee of the National Assembly and the National Assembly regarding the draft Law in accordance with the Law on Promulgation of Legal Documents; and to take responsibility for the content of the reports.

Putting workers at the center

According to the Ministry of Home Affairs, the draft Law on Public Employees (amended) is designed on the principle of inheriting and revising the provisions of the 2010 Law on Public Employees (amended and supplemented in 2019) to conform to the new regulations of the Party and in line with established principles, objectives, and specific contents.

The draft Law on Public Employees (amended) focuses on improving the human resource management mechanism in the direction of putting workers at the center, creating flexibility in the use of both public and private human resources, establishing mechanisms to attract high-quality human resources, reducing administrative procedures, addressing shortcomings and inconsistencies in the current legislation, while meeting the requirements of national governance reform and building a contingent of public employees who are professional, responsible, dynamic, and dedicated to serving the people.

It also emphasizes reviewing and supplementing policies to ensure that public non-business units are given autonomy in human resource management and utilization, in line with the new guidelines of the Politburo and practical conditions.

Objectives of the draft Law on Public Employees (amended)

Establish a flexible recruitment mechanism enabling public non-business units to attract, arrange, utilize, remunerate, train, and foster public employees, workers, experts, and scientists in line with the human resource needs and financial capacity of each unit; allow public non-business units to operate as economic entities (for autonomous units); create flexible mechanisms for recruitment, evaluation, and utilization appropriate to the degree of autonomy, based on the principle of serving the community; develop flexible workforce management mechanisms in an open manner, adaptable to all organizational models; and establish sufficiently open mechanisms so that each unit may “design” its own way of managing, utilizing, and recruiting its workforce.
