(L&D) – The draft Decree amending and supplementing Decree No. 100/2024/ND-CP proposes assigning the commune police to verify income eligibility for purchasing social housing instead of the commune-level People’s Committees.
Accordingly, for the subjects specified in Clauses 5, 6, and 8 of Article 76 of the Law on Housing, the income conditions must be met as follows:
In the case of an applicant who is unmarried, divorced but not remarried, or certified as single, the average actual monthly income must not exceed VND 20 million, based on the payroll or wage statement certified by the agency, unit, or enterprise where the applicant works.

In the case of an applicant who is unmarried, divorced but not remarried, or certified as single and raising a minor child, the average monthly income must not exceed VND 30 million, based on the payroll or wage statement certified by the agency, unit, or enterprise where the applicant works.
In the case of an applicant who is legally married, the applicant and his/her spouse must have a combined average actual monthly income not exceeding VND 40 million, based on the payroll or wage statement certified by the agency, unit, or enterprise where the applicant works.
The period for determining income eligibility is the 12 consecutive months preceding the time when the subject specified in this clause submits a valid application to the investor for registration to purchase or lease-purchase social housing.
In the case where the subject specified in Clause 5, Article 76 of the Law on Housing does not have a labor contract, he/she must still meet the prescribed income conditions and obtain confirmation from the commune police at the place of permanent/temporary residence or current residence.
Within 7 days from the date of receiving the request for confirmation, the commune police at the place of permanent residence or current residence of the applicant shall, based on the population database, carry out the confirmation of income eligibility.
Meanwhile, under the current provisions of Article 30 of Decree No. 100/2024, the commune-level People’s Committees are responsible for verifying income eligibility within one consecutive year from the time when the subject specified in this clause submits a valid application to the investor for registration to purchase or lease-purchase social housing.
Accordingly, the draft Decree proposes assigning the commune police to verify income eligibility for purchasing social housing instead of the commune-level People’s Committees.
Regarding income eligibility for purchasing housing, under Decree No. 100/2024, in the case of a single applicant, the actual monthly income must not exceed VND 15 million, based on the payroll or wage statement certified by the agency, unit, or enterprise where the applicant works.
In the case of an applicant who is legally married, the applicant and his/her spouse must have a combined actual monthly income not exceeding VND 30 million, based on the payroll or wage statement certified by the agency, unit, or enterprise where the applicant works.
The period for determining income eligibility is one consecutive year from the time when the subject specified in this clause submits a valid application to the investor for registration to purchase or lease-purchase social housing.
This period for determining income eligibility applies to the following groups: low-income earners in urban areas; workers and laborers employed in enterprises and cooperatives both inside and outside industrial zones; and officials, public employees, and civil servants.
