(L&D) - On the morning of 13 November, Deputy Minister of Justice Nguyen Thanh Tu held a working session with ministries and agencies on the draft Research Report and the formulation of the Project “Improving the Structure of Viet Nam’s Legal System to Meet the Requirements of National Development in the New Era” in the fields of culture, education, social management, and development.

At the working session, Deputy Minister of Justice Nguyen Thanh Tu stated that, pursuant to the directives of the General Secretary regarding the formulation of the Project “Improving the Structure of Viet Nam’s Legal System to Meet the Requirements of National Development in the New Era,” over the past nearly three months, with the coordination of experts, scientists, and ministries and agencies, the Ministry of Justice has been developing the draft Project.

The draft Project comprises three parts, including general issues on the structure of the legal system; international experience in designing the structure of Viet Nam’s legal system; assessment of the current state of the structure of Viet Nam’s legal system; achievements in building and improving the structure of Viet Nam’s legal system; limitations and shortcomings of the structure of Viet Nam’s legal system in response to national development requirements in the new era; the context, viewpoints, objectives, and solutions for improving the structure of Viet Nam’s legal system to meet national development requirements in the new era; and the list of legal normative documents…

Deputy Minister Nguyen Thanh Tu requested that delegates representing ministries and agencies with functions and responsibilities in the fields of culture, education, social management, and development focus on exchanging and discussing general contents and practical issues in their respective areas; and propose solutions, recommendations, and suggestions to help the Ministry of Justice best complete the draft Project.

At the working session, Dr. Nguyen Van Cuong, Director of the Institute for Strategy and Legal Science, Ministry of Justice, provided information on some fundamental contents of the draft Project “Improving the Structure of Viet Nam’s Legal System to Meet the Requirements of National Development in the New Era” in the fields of culture, education, social management, and development, as well as the draft Research Report.

Dr. Nguyen Van Cuong stated that there have been several Resolutions setting out policies in the field of culture; draft documents of the 14th Party Congress and ten Laws also include provisions in this field but remain insufficient. Dr. Cuong exemplified that recently, the Minister of Culture, Sports, and Tourism reported plans to develop a Law on Cultural Industries. However, simply referring to a Law on Cultural Industries remains very general.

In addition, this Law needs to clearly reflect the role and responsibility of the State in promoting cultural development. The State’s enabling role in the cultural sector is extremely important. The achievements of South Korea in the cultural industry today are due to the clear role of the State in developing the cultural industry. Therefore, to promote cultural industries and cultural development, Viet Nam needs to make concrete plans.

Regarding the field of education, according to Dr. Nguyen Van Cuong, a general law is expected, namely the Law on Education, followed by a series of sector-specific laws. The Ministry of Education and Training has recently proposed further amendments and supplements to the Law on Higher Education and the Law on Vocational Education, but additional provisions are still needed. According to the development process, the field of education law will include sector-specific and specialized laws, and a law to encourage private education is necessary. In addition, it is necessary to develop laws on education for persons with disabilities, lifelong education, and lifelong learning, ...

Regarding labor and social security, the Labour Code will be developed as the general, foundational law in the labor sector. Concerning social security, the Law on Social Insurance is the general law, while other social security laws are sector-specific or it may be considered to promulgate a Law on Social Assistance…

Director Nguyen Van Cuong requested that ministries and agencies continue to provide feedback on the contents of their respective fields; determine which laws under their ministries and agencies will be considered general laws of the sector, and which laws are specialized or sector-specific under the general law…

At the working session, a representative of the Ministry of Culture, Sports, and Tourism stated that there are 424 legal documents related to the cultural field, including 13 Laws, 77 Decrees, with the remainder being Decisions, Circulars, etc. Agreeing on the necessity to improve the structure of the legal system, this representative said that next year, the Ministry plans to submit a law amending multiple laws: the Law on Tourism, the Law on Cinema, etc.; and raised a question regarding the development of legislation in the form of framework laws and specific laws, asking whether this approach could limit subordinate legal documents…

A representative of the Ministry of Home Affairs agreed with the solutions proposed in the draft Research Report. Regarding the field of labor, the Ministry of Home Affairs agreed with the orientation to define the Labour Code as the general law, followed by specialized laws: the Law on Employment, the Law on Vietnamese Workers Working Abroad under Contracts…

Regarding social insurance, according to the Ministry of Home Affairs representative, if the Law on Social Insurance is defined as the general law compared to other laws such as the Law on Health Insurance and the Law on Children, would it be necessary to amend the Law on Social Insurance to make it general and comprehensive for other related areas…

Concluding the working session, Deputy Minister of Justice Nguyen Thanh Tu expressed hope that ministries and agencies will continue to study and provide feedback on the draft Research Report, helping the Ministry of Justice gain an overall perspective and complete the draft Project.
